IPR E-Registration :

1. Firstly, the applicants must decide as to with which Commissioner of Customs in India they would prefer to file the Notice for recordation/registration of intellectual property right (IPR) in terms of Rule 3 of the Intellectual Property Rights (Imported Goods) Rules, 2007.

2. The applicants have to draw a demand draft from any nationalized or scheduled bank in favour of that Commissioner of Customs, where they want to file the notice and keep the demand draft ready before accessing the web-enabled application/notice.

3. Please keep the soft copies of all the documents like Registration Certificate, Title Deed, Authorization, Power of Attorney, Digital images of genuine copies/goods, Digital images of infringing goods etc ready for uploading into the System. It may be noted that all the document files should be uploaded in ‘PDF’ format and all the relevant images should be uploaded in (“.jpg”, “.png”, “.gif”, or “.tif” ) format only.

4. Please log-in to the icegate.gov.in and choose the IPR Module to go to the IPR E-Registration page and select the appropriate Indian Customs Registry from the dropdown listing five types of IPR-viz- Copyright, Trademark, patent, Design and Geographical Indication. The System will make it mandatory to go through the Applicant’s Guide before proceeding for the recordation.

5. Before submitting the notice please make sure that all mandatory fields are correctly filled –in.
6. If the applicant has missed to enter any details pertaining to a field, a popup will appear asking to fill the details, when he/she tries to go to the Next page. If the Applicant does not upload any of the mandatory files and moves to the next screen, a red ticker will appear on the top of the screen prompting to upload the required file. The Applicant, in this case, should go back to the previous screen by using the ‘Back’ button in the browser, upload the file and the blank fields (if any) and then move to the next screen again.

7. As compliance to the provisions of Rules 5(a) and 5(b), the right holder seeking the protection from Indian Customs shall have to execute a general bond and an indemnity bond.

8. Though applications can be filed by right owners or right holders or any other authorized persons, the general bond and indemnity bonds have to be executed only by the person seeking protection. However, for smooth process flow of the electronic document, the applicant, not being the owner or holder of the right, can also merely agree to furnish them along with the hard copy of the printed on-line application to the chosen Commissioner of Customs.

9. Any missed or incorrect data elements can be checked and edited at the end. You will be prompted to verify the same before it is finally submitted to the System.
10. After the Declaration page, the applicant will not be able to go back to the previous screen.

11. Information sought through the notice is general in nature and the data elements required to be furnished are in line with the common terminology applicable for majority of the IPR types. The data sought from the applicants is meant for according appropriate protection. It is, therefore, advised that applicants provide full and correct particulars for achieving desired results.

12. After verifying the details, the on-line application can be submitted to the System. On successful submission, a Unique Temporary Registration Number (UTRN) will be generated and the same will appear on the screen. This number can be noted and secured so that all further correspondence with Customs can be made invariably with reference to this UTRN. This UTRN will also be communicated to the registered E-mail Id of the applicant.

13. Please take a printout of the application as prompted by the System and submit the same to the Commissioner of Customs, chosen by you. However, all the supporting documents, including the Demand Draft, General Bond and Indemnity Bond shall be submitted along with the notice, to the Commissioner of Customs for further necessary action.

14. Any other document sought by the office of the Commissioner of Customs may also be submitted by the applicant.
15. After approval of the application for recordation by the Commissioner or his Authorized Officer, the UTRN will be converted to UPRN (Unique Permanent Registration Number) which will also be communicated to the registered E-mail Id of the applicant.
16. It may be noted that incomplete or incorrect applications will be rejected.
