1. My grandmother has expired 8 years ago and now we have applied for a legal heir certificate. There are 5 members who are legal heirs of my grandmother. So is that enough, if my father is alone applying for the heir certificate on behalf of his siblings with all their attested address proof? (or) everyone should fill the form individually with their attached address proof?

2. My grandfather has purchased a property in Chennai suburbs. He has died without leaving any will in 1981. Subsequently, my father has also died in 1987. The property has to be transferred to the legal heirs. We are native of Chennai but, live in other states due to our job and profession. Some of us are having our own house at Chennai. Kindly let me know, where should we apply for Legal Heir Certificate. Is it possible to obtain Legal Heir Certificate from other than Tamil Nadu?

Answer:
Yes. You can get a legal heir certificate without your grand father’s signature. The application for legal heir certificate is available in the web site. Any one of the legal heir to your father (i.e. wife son, daughter widow of a predeceased son etc.,) can apply for LHC. The main fact is that the applicant should submit his application for LHC to the Tahsildar who is having jurisdiction to his address. You must also enclose copy of death certificate, residential proof, purposes for getting LHC together with copies of related documents.

5) You will be redirected to a new page where you can fill out the application form.
6) Enter your details, such as your name, date of birth, and contact information.
7) Enter the details of the deceased person, such as their name, date of birth, and death certificate number.
8) Enter the details of the legal heirs, such as their name, date of birth, and relationship with the deceased person.
9) Upload the required documents, such as the death certificate, the Aadhaar card of the deceased person, and the Aadhaar cards of the legal heirs.
10) Click on the “Submit” button.

My father applied for the Legal Heirs Certificate of my mother, in the year 09/12/2010 the L.H.Certificate was issued to me on 07/03/2011 at that time I missed out the gender mentioned against my name. My name was mentioned correctly but the gender was mistakenly mentioned as female. When I went and asked them for the correction they stated that the application submitted by my father was misplaced as such they can’t help me out. I had filed RTI for the same and the Thasildhar who was present during the year 2017 said that he can change the gender only if they are able to trace the L.H.Application forms .Sir, Till date I am not in a position to get the same. Can someone please help me out regarding the same. I have the original legal heirs certificate issued by the then Thasildhar of Tambaram, Chennai, Tamilnadu on 07/03/2011

      Yes. You can get a legal heir certificate without your grand father’s signature. The application for legal heir certificate is available in the web site.       Very simple. If you know the date of death of your father you may get a copy of death certificate from the website. Along with the death certificate of your father you may apply for LHC.

    One of my friend has settled in abroad and his brother is living in Chennai. If something happens to his brother how can he get legal heir certificate in India since his brother is not married?

      If his brother is a bachelor and having property, ask him to settle the property in favour of his brother. The person settling the said property shall retain life interest only in the said property. If no such document is registered, it would be difficult to get a succession certificate from the competent court and the expense would go to about one lakh.

      You must submit your application to the Tahsildar in whose jurisdiction you are living.

      What is the name mentioned in the death certificate of your grand father? If there is major corrections in it, you may apply for a fresh LHC together with copies of documents showing the correct name of your grandfather’s father.

      In Chennai District the Tahsildars are not insisting for the Ration cards of the other legal heirs. However, if you know their residential address you may download a copy of their Electoral roll as a proof.

My sister had applied legal heir certificate in Malaiyur RI/VO office (Thiruvannamalai dist, Tamilnadu) due to family disputes her father in law and mother in law not accept to sign in acceptance letter.       Have you received any rejection letter from the Tahsildar concerned. In such case, you may prefer an appeal to the District Collector, with reasons and get direction to Tahsildar concerned for issue of LHC.

      There wouldn’t be any problem. In the LHC you mention both the names of your mother if it is Alia. If her name is twice in the Ration card, you may submit an application to the Assistant Commissioner, Civil Supplies and get one name deleted and then apply for LHC.

  24. There is no cardial relationship between legal heirs. The taluk authority expects all legal heirs should present physically before him. The copies of documents – death & legal heirs certificates of the deceased legal heirs are not verified by this authority. They do not want to consider them. There may be around thirty persons in the legal heirship list. This authority informed to seek legal remedy which is expensive and time delay procedure. How can I compel this authority to do field verification in the deceased parent place to verify the genuineness of my records?

      You make a complaint to the RDO or the District Collector regarding the stand taken by the Tahsildar.

  25. My husband expired. But Marriage was not registered. How can I get legal hire certificate?

    1. A. Dhurga Sghankar

      No problem. You must submit your application to the Tahsildar who is having jurisdiction to your address. You must submit a copy of your husband’s death certificate, together with copies of documents for which purpose the LHC is required.

      The LHC is issued by the Tahsildars purely on the outcome of the local inquiry. There is no need for a Marriage certificate. Straightaway you apply for a LHC along with copies of other documents you have.

  26. My uncle have two houses, one in Velachery and one in Avadi. He died in Avadi House. But his wife is staying in Saidapet and having address proof for Velachery address. Now where she has to apply for legal heir certificate?

      Ask your uncle’s wife to obtain residential proof for her residence in Saidapet (Voter’s ID. Ration card, Gas connection etc., Then she has to apply for LHC to the concerned Tahsildar within whose jurisdiction her address falls.

      You can’t get an LHC without the name of your mother. Since your mother is also a legal heir to your father, you apply for LHC in both of your names.

      You should apply for an LHC in your native place only. The Tahsildar of your native place may require a certificate to be produced by you from the Chennai Tahsildar stating that you have not been issued with any LHC in Chennai.

  42. I have address proof in Pondicherry but land in Tamil Nadu. Is that a problem?

    1. First you need to apply death certificate. You can get it in 2 to 3 days after registration. Once you got the death certificate, you need to apply varisu certificate (legal heir). It will take 15 to 20 days; if there is no problem. Some details and xerox copies needed to apply varisu certificate like xerox copies of death certificate, ration card, etc

    First you have to fill the form,and stick a 2rs stamp on the form. Then Buy a 20rs form and go to any type set center. They will ask you some details to fill that form. After that you have to go to any one notary advocate with for attestation. After that staple all papers and give it to you Dhasildhar office.
