We come across many people approaching us with tenancy related problems.

Some face problems in renting out their premises to the prospective tenants and some owners face problems to get the tenant vacated. On the other hand, tenants feel that the landlord or the owner is cheating them by collecting hidden taxes, not providing what has been promised and the list of grievances is endless. We want to extend you a helping hand till we get comprehensive tenancy legislation in our state. We consulted noted legal luminaries and prepared the following checklist for you.

Checklist

Checklist for the leasing out premises
** Date of the Deed and Parties (Clear and detailed addresses are important. Identifiable persons, their age, father’s name or husband’s name, profession, residence should be given. Date is significant )
** Description of the Property (any mistake in description can render the deed useless, and give rise to unnecessary litigation, wrong boundaries, wrong house numbers, mention of wrong area name could create problems) Who is lessor and who is lessee- Whether expression include their legal representatives also-

Terms and Conditions

Terms and Conditions (should be specific to avoid the future disputes) :
** Monthly Rent (Negotiated and agreed amount)
** Security Deposit (Negotiated and agreed)
** Maintenance and Taxes (Negotiated and agreed)
** Duties of Lessee (Bearing the cost of Maintenance, keeping premises clean, Replace broken fittings etc, provide lessor right to enter and any other agreed duty)
** Cost of the deed (to be borne by lessee)
** Right to receipt (right of lessee)
** Effect of breach (eviction)
** Right to passage (duty of lessor to provide)
** Duty to deliver vacant possession (of lessee, after end of term)
** Termination with notice (Clause which entitles either party to terminate the contract of lease)
** Ending or extending term (Can be extended to be agreed upon certain conditions afresh)

Execution and Witnesses (both lessee and Lessor have a duty to execute deed by Signing and witnessing signatures by witnesses)

Schedule and the map (with signatures) for clear location of the leased premises, any mistake could render the deed useless.

About Us :

Hyderabad was the Capital of Nizam. As per the available records, the Police Commissionerate system existed way back from the year 1847. The Nizam of Hyderabad used to appoint the Commissioners of Police who were officers of the Hyderabad Civil Service and they used to function during his pleasure.
